The Competition Agency, In The Direction Of Consumer Protection, Established The Fact Of Violation To The Company "Modus"

The Georgian National Competition Agency has completed the case study against the company "Modus" and established the fact of the violation of the Law of Georgia on the Protection of Consumer Rights, in the construction and renovation materials trade sector.

As a result of the assessment and study of the circumstances of the case and the presented evidence, it was confirmed by the trader - the fact of violation of the main obligation to provide information to the consumer and the obligation to replace/repair/return the defective item. According to the decision of the National Competition Agency, the trader was instructed to:

- To change the company’s internal policy and to restore the rights of those consumers who allegedly suffered damages due to the trader’s policy, within 1 month.

- Comprehensibly and fully provide the information to a consumer defined by the law in the national language of Georgia at the trade stores and on the website www.modus.ge,  including the obligation related to the replace/repair/return of the defective item;

- To develop the conditions for the withdrawal from the contract and the procedure for introducing it to the consumers;

- To establish clear guarantee conditions in accordance with the law.


For information: In the direction of the protection of consumer rights, from November 2022 - to August 2023, the National Competition Agency has received 360 applications and a case study has been started on 209 applications. For 10 months, the Competition Agency signed 64 commitment agreements in favor of the consumer on 100 cases. At the time, the issue regarding the 32 commitment agreement signed in 52 cases has been completely exhausted. In the same period, according to the Agency’s decision, the 20 facts of violations of the rights of the consumer group were confirmed -in 34 cases, and in 4 cases were not confirmed.

Due to non-fulfillment of the obligation imposed by the Agency, 4 traders were fined in 15 cases.
